civil judgment enforcement

In a civil case a judgment may be awarded to a plaintiff by a judge or a jury. This judgment is usually in the form of financial compensation.

While the majority of people comply with civil judgments and pay when they are liable, some do not, and it’s then that a plaintiff must pursue civil judgment enforcement.

The first step, however, is for the plaintiff to go back to court to be able to enforcement the judgment on the indebted party. The plaintiff may need the assistance of an attorney to get the judgment enforced.

A civil judgment can be enforced in multiple ways. A court may:

  • Place a lien on the defendant’s property or land
  • Give the plaintiff the right to collect money from the defendant’s bank accounts
  • Place a restraining notice on the defendant’s bank accounts to stop them from withdrawing money
  • Garnish the defendant’s wages
  • Hold the defendant in contempt of court
  • Suspend the defendant’s driver’s license or car registration
  • Suspend or block the granting of a business license

It’s important that a plaintiff take the time to gather as much information as they can on the defendant. A plaintiff who is looking to enforce a civil judgment may want to hire an asset search company to help look for any assets the debtor may own.
